In order to implement the reform requirements of the State Council’s “delegation of control, decentralization, and service”, and to effectively strengthen the management of qualification accreditation for inspection and testing institutions, the CNCA and provincial quality and technical supervision and management departments (hereinafter collectively referred to as qualification accreditation departments) have carried out a series of streamlining administrations, delegating powers and releasing powers. The dividend reform measures have promoted the rapid and healthy development of my country's inspection and testing service industry. On January 17, 2018, the State Council issued the "Opinions on Strengthening the Construction of Quality Certification System and Promoting Total Quality Management" (Guo Fa [2018] No. 3, hereinafter referred to as the "Opinions"), which proposed the implementation of unified management of qualification certification and simplified management. The requirements for standardizing the qualification accreditation procedures of inspection and testing institutions and strengthening supervision during and after the event have pointed out the new direction of the reform and development of the qualification accreditation of inspection and testing institutions. In order to adapt to the new situation and new requirements, implement the work tasks proposed in the "Opinions", and promote the formation of a unified new pattern of qualification accreditation, after research, the relevant work requirements for further promoting the unified implementation of the qualification accreditation of inspection and testing institutions are clarified as follows, please all units Complied.

1. Promote the establishment of a unified qualification accreditation system for inspection and testing institutions

(1) Improving the coordination mechanism for the qualification accreditation of inspection and testing institutions

The qualification accreditation department shall conscientiously implement the "Opinions" of the State Council and the reform requirements of the administrative licensing system, follow the basic principles of uniformity, openness and convenience in the qualification accreditation of inspection and testing institutions, strengthen communication and coordination with relevant industry authorities, and jointly study and formulate It will also release the qualification accreditation review requirements for relevant inspection and testing fields, establish a cross-industry joint review mechanism, promote the acceptance of the qualification accreditation of inspection and testing institutions, and accelerate the establishment and improvement of a unified national inspection and testing institution qualification accreditation management system.

(2) Allow special field inspection and testing institutions to be included in qualification accreditation

1. If laws and regulations (such as the "Special Equipment Safety Law", "Fire Protection Law", "Seed Law", etc. have corresponding provisions on the qualifications and qualifications of inspection and testing institutions, they shall follow the principle that special laws are superior to general laws .

2. Laws, regulations, and rules do not clearly stipulate areas that need to be certified, and relevant inspection and testing institutions are not compulsory as the target of qualification certification. For industry authorities that have corresponding management needs, the qualification accreditation department is encouraged to actively carry out the qualification accreditation work of inspection and testing institutions in the above-mentioned fields, and gradually incorporate them into the qualification accreditation system of inspection and testing institutions. In areas where qualification accreditation is implemented on a pilot basis, the in-process and ex-post supervision of the accreditation department is only conducted for the inspection and testing institutions that have obtained the accreditation.

(3) Qualification accreditation of standardized inspection and testing institutions

1. The scope of competence of an inspection and testing agency to apply for qualification accreditation shall include two parts: method standards and product standards. The method standards cited in the product standards should also be individually qualified.

2. Group standards with independent innovation technology and competitive advantages can apply for qualification accreditation. When applying for group standards, inspection and testing organizations need to provide method verification reports and relevant standards and technical advantages, leading, and innovative instructions issued by the standard issuing group.

3. In addition to the qualification accreditation review requirements that have been revised by the CNCA or issued in the form of certification and accreditation industry standards, the “Notice of the CNCA on Printing and Distributing Supporting Working Procedures and Technical Requirements for the Qualification of Inspection and Testing Institutions” (National Relevant annexes issued by Jianshi [2015] No. 50) will continue to be implemented.

2. Promote the reform of the qualification accreditation system to reduce the burden on inspection and testing institutions

(1) Actively promote the "five reductions"

1. The qualification accreditation department should promote the "five reductions" (reduction of procedures, reduction of links, reduction of time, reduction of fees, reduction of application materials) requirements in accordance with the "Opinions", combined with the application items of inspection and testing agencies, classified supervision and agency self-declaration, etc. Situation, simplify the licensing procedures. For inspection and testing institutions that comply with relevant regulations, gradually adopt methods such as document review and self-declaration of acceptance agencies to quickly make decisions on whether to approve the renewal or change of qualifications.

2. The qualification accreditation department shall, in accordance with the requirements of the State Council’s administrative examination and approval standardization, sort out and standardize the processing procedures for the application, acceptance, review, and decision of examination and approval items, rationally allocate the examination and approval authority, and optimize the internal examination and approval process.

3. The qualification accreditation department shall strengthen the informatization construction of the qualification accreditation work, make full use of Internet means, realize the online processing of the entire process of application, approval and issuance, and improve the efficiency of approval. When the inspection and testing agency applies for the expansion of qualification accreditation and review and review, if there is no major change in the legal status and management system, there is no need to submit materials such as quality manuals, procedural documents and copies of the original qualification certificate.

4. The qualification accreditation department shall strictly implement the requirements of the "Notice on the Cancellation and Suspension of a Batch of Administrative Fees" (Caishui [2015] No. 102), and shall not collect metering certification license fees, and actively apply to the financial department at the same level Expenses required to perform functions.

5. For inspection and testing institutions that have obtained the CMAF Certificate of Qualification for Food Inspection Agency (CMAF), they will not be renewed after the expiration of the Qualification Certificate of Food Inspection Agency. According to the specific situation of the organization, the qualification accreditation department may adopt the method of written or on-site review to include the original food inspection and testing capabilities into the scope of the qualification accreditation (CMA) of its inspection and testing institution.

6. The official seal of the inspection and testing agency is the proof that it is engaged in relevant activities in accordance with the law. If the inspection and testing agency affixes the official seal on the inspection report or certificate, it is deemed to be stamped with a special inspection and testing seal.

(2) Encourage the cross-regional development of inspection and testing institutions

If an inspection and testing institution needs to set up a cross-province inspection and testing site in accordance with its business development, it shall establish a branch in accordance with the law, and the provincial qualification certification department where the branch is located is responsible for the certification and post-licensing supervision of the inspection and testing agency.

3. Strengthen the supervision of inspection and testing institutions during and after the event

(1) Strictly investigate and deal with false inspections

If false inspection data and results are issued without inspection or testing or tampering with data or results, the qualification accreditation department shall revoke its qualification accreditation certificate, and the inspection and testing institution whose qualification accreditation certificate has been revoked shall not apply for qualification again within three years Identified.

2. If an inspection and testing institution provides false materials or conceals relevant information when applying for qualification accreditation, the qualification accreditation department will not accept or grant permission, and the inspection and testing institution shall not apply for accreditation again within one year.

(2) Regulating the handling of complaints and reports on the qualification accreditation of inspection and testing institutions

The qualification accreditation department shall promptly accept complaints and report cases related to the qualification accreditation of inspection and testing institutions, and investigate and deal with them. The content of the complaint and report is a dispute over inspection and testing results or standard use, and if there is no clear violation of the relevant requirements for qualification certification, the relevant inspection and testing agency may be included in the key supervision objects.

(3) Standard inspection report and certificate

Inspection reports and certificates that are not stamped with the Qualification Accreditation Mark (CMA) do not have the role of proof to the society. When an inspection and testing agency accepts relevant business entrustment, involves projects that have not obtained qualification certification, and needs to issue an inspection report and certificate, the relevant inspection report and certificate shall not be stamped with the qualification accreditation (CMA) mark, and should be noted in the prominent position of the report. It is stated that “the relevant project has not obtained qualification certification and is only used for scientific research, teaching or internal quality control” or similar expressions.

(4) Strict supervision of food inspection agencies

Food inspection institutions (or inspection and testing institutions with food inspection capabilities, when related to food inspection issues) shall comply with both the "Administrative Measures for the Accreditation of Food Inspection Institutions" (AQSIQ Order No. 165, hereinafter referred to as Order No. 165) and The relevant requirements of the “Administrative Measures for the Qualification Accreditation of Inspection and Testing Institutions” (AQSIQ Order No. 163, hereinafter referred to as Order No. 163). Where food inspection agencies have related violations, they shall be dealt with severely in accordance with the provisions of Order No. 163 or No. 165.
